On numerous occasions, businessmen and entrepreneurs are confused and do not know how to differentiate between a brand and a company name, when in reality, they are completely different and independent of each other.

Are a Company Name and a Brand the same thing? What you should know.

In the business world, it is essential to understand the differences between a company name and a brand, since both terms are fundamental to the operation and identity of a company. Although often used interchangeably, they represent different concepts that play key roles in the success of a business. In this article, we explore the distinctions between a business name and a brand, as well as their importance in the business environment.

Social Reason

The corporate name is the legal name under which a company operates and is registered with the corresponding government entities. It is also known as “company name” or “corporate name”. This name is necessary to establish the legal identity of a company and usually includes elements such as the legal form of the company (for example, S.A., S.L., Ltda., etc.) and, in some cases, additional information about the company's main activity.

Corporate names are unique and cannot be used by other companies within the same jurisdiction. They have a mainly legal and administrative purpose, since they are required to carry out legal procedures, open bank accounts, sign contracts and pay taxes. However, the company name alone does not usually communicate information about the identity of the company or its products and services.

Brand

On the other hand, a brand is a sign that makes it possible to differentiate products or services from others in the market. In other words, it is an intangible asset that represents the identity, values and promise of a company to its customers and the general public. A brand goes beyond a simple name; it can include a name, logo, slogan, graphic design, colors, and other visual and emotional elements that are used to distinguish a company's products or services from those of its competitors.

Brands play a crucial role in creating a strong brand identity and in connecting emotionally with consumers. When consumers see a familiar brand, they may associate it with certain qualities, experiences, or values. Examples of globally recognized brands include Apple, Coca-Cola and Nike, whose names and logos evoke not only products, but also a specific experience and brand image.

Example

We can see the difference between a company name and a brand if we use Telcel as an example. On the one hand, the legal name (company name) of Telcel is “Radiomovil DIPSA, S.A. de C.V.”, while the commercial name (brand) is “Telcel”. With this example, it can be seen that the corporate name has legal and administrative purposes, such as the signing of contracts with its clients or the declaration of taxes, while a brand is the sign that represents the company's services from a commercial perspective.

Key Differences

  1. Purpose: The corporate name is mainly used for legal and administrative purposes, while the brand has a commercial and identity purpose.
  2. Registration: The company name is registered with the Ministry of Economy, while a trademark is registered with a trademark and patent office to protect it from unauthorized use.
  3. Scope: The corporate name is limited to a specific legal entity, while a brand can encompass multiple products, services and geographical locations.
  4. Communication: The corporate name alone does not communicate information about the company, while a brand is designed to convey a distinctive identity and message.

Conclusion

In short, the difference between a business name and a brand lies in its purpose, scope and function. The corporate name is a legal name that identifies the company before government authorities, while the brand is an identity and marketing tool that seeks to connect with consumers and stand out in a competitive market. Both are important for the success of a company, since the corporate name establishes its legal existence, while the brand builds its image and reputation in the market. Both elements work together to form the complete business identity.
